PART I.  THE THIRD-PARTY FUNDING LANDSCAPE

1.   The TPF market in Bosnia and Herzegovina

1.1. Please shortly describe the TPF market in your Jurisdiction.

First, it should be noted that Bosnia and Herzegovina (“BH”) is a complex and decentralized state, and it consists of two entities and one self-governing administrative unit, i.e.:

•   the Federation of Bosnia and Herzegovina (“FBH”);

•    Republika Srpska (“RS”); and

•    Brčko District Bosnia and Herzegovina (“BD”);

(FBH, RS and BD together are referred to as “Entities” in the following text).

The Entities constitute separate jurisdictions which in some matters hold exclusive competency to legislate, and in other matters share competency at the state (BH) level or with the lower and/or local governance units, and in still other matters hold no competency at all.

For the purpose of this report, we have given unified answers where appropriate, whereas we have separately emphasized any relevant differences in the legislation, by Entities, respectively.

TPF is not regulated by legislation in BH or by arbitration rules of the arbitral institution in BH.

1.2. Is it dominated by local or international Funders? Which Funders are active? Which cases typically get funded?

Having in mind that TPF is not regulated in BH, there is no publicly available information in this regard.
