Avoiding Evident Partiality in Borst v.
Allstate Ins. Co.

I. OVERVIEW
Russell Borst (Borst) was injured in an automobile accident
with an uninsured motorist on November 23, 2000.1 Borst filed a
claim for reimbursement of his damages from his insurance
provider, Allstate Insurance Company (Allstate), pursuant to his
uninsured motorist coverage policy.2 Allstate believed that Borst
was fifty percent liable for the accident and would therefore
