In 1980, the Equal Employment Opportunity Commission issued new guidelines on national origin discrimination. This article discusses the way in which the courts and arbitrators have dealt with the issue in the past and shows how these groups helped to shape the new guidelines. While cognizant of the limitations of external guidelines on arbitration, the author suggests that impartials can aid in reducing national origin discrimination, even in the absence of collective agreement, by resolving disputes and contributing to the reduction of administrative and judicial caseloads.
