I. OVERVIEW
The dispute arose over the failure of Tatung Company (Tatung) to
pay royalties to Lucent Technologies, Inc. and to Lucent Technologies,
GRL L.L.C. (Lucent) under their patent licensing agreement.1 Lucent
initiated arbitration against Tatung in October 2000 pursuant to an
arbitral clause in the agreement.2 The arbitration clause specified that
each party was to appoint one member of an arbitral panel and that the
two party-appointed panel members would select a neutral third
member.3 The arbitration agreement specified that the arbitration was to
be governed by the International Rules of the American Arbitration
Association (AAA).
