A survey of disputes in environmental matters shows that cases are increasing in number and scope and that not only the courts but government agencies are backlogged. In many cases, this article shows, ADR techniques are able to produce much quicker and better results. In certain instances, environmental groups are committed to the court trial process to punish offenders with large penalties.
