Unlike prosecutors, mediators work alone and develop their own approach to cold cases.

Master Mediator Paul F. Monicatti of Troy, Mich. (see his web profile at http://bit.ly/2Fr8WcI), regularly monitors the litigation status of mediated cases that had reached impasse. Although I do not think it is a regular practice for mediators to follow every case where negotiations failed, many mediators do routine follow-up periodically.

I confess I have no tickler or tracking system in place. If I believe follow-up will be effective, I make a note on my paper calendar to do a check-in at what I estimate to be an appropriate time. Since my calendars are usually 15-month duration, this usually occurs three-to-six months following the last contact with counsel.
