I. INTRODUCTION
Practitioners face a variety of legal challenges when seeking to
either set aside or recognize and enforce a private commercial
arbitration award in Mexico. Our intention in writing this Article
is to provide a practical, rather than an academic, contribution to
the literature on this topic. In so doing, we also wish to
commemorate and pay our respect to an academic and
practitioner who has contributed to the field for the last five
decades: Mr. José María Abascal Zamora.1
Our aim is to share some thoughts, experiences and “lessons
learned” that we have faced while participating in arbitrations
and their court-related proceedings. A word of caution: while we
are describing our personal experiences, keep in mind they
should be put within the context in which we tried the cases.
It is not our aim, however, to suggest that Mexico is not a
suitable seat for arbitration. Just the opposite: Mexico has evolved
