I. Introduction

The Irish Constitution is one of few containing an explicit commitment to international arbitration. Article 29.2 reads: “Ireland affirms its adherence to the principle of the pacific settlement of international disputes by international arbitration or judicial determination.” This provision, of course, refers to the arbitration of disputes between nations and probably owes its genesis to the fact that the principal political architect of the Constitution was President of the Council of the League of Nations at the time the article was being drafted.1
