I. INTRODUCTION
Generally, agility, speed and flexibility are recognized as
features that exemplify the arbitration process, in contrast with
the perceived slowness of civil procedure. The slow pace of
justice is often described as endemic, resulting in the assertion
that justice delayed is justice denied. As in public administration,
steps are being taken in the administration of justice to
computerize (“electronification”) procedures and information
processing. Indeed, procedural law admits evidence that is based
on electronic media or developed electronically.
It is urgent, therefore, that arbitration uses all electronic and
long-distance means of transmission (“telematic”) to facilitate and
expedite arbitral procedure. The flexibility of arbitration, based
on the principle of party autonomy means that, even without an
enabling rule, the parties may agree to use electronic media.
Parties relying on arbitration, especially in the commercial
sphere, are looking for expeditious and effective dispute
resolution procedures. Therefore, both parties are likely to share
a common interest in the use of new technologies that facilitate an
arbitral resolution of the dispute in the shortest time possible.1
