1. INTRODUCTION

As the international governing body of football, FIFA is involved
in three distinct kinds of disputes within the area of sport. To address
these matters, FIFA relies on three different dispute resolution systems.
 
2. NON-COMMERCIAL DISPUTES: DISPUTES RESULTING
FROM THE FIELD OF PLAY
 
The first category of disputes concerns those that take place on
the field of play, where the referee acts as policeman, prosecutor and
judge. Prior to the introduction of referees in 1882, it was the role of the
two team captains to decide whether there was a foul play or any other
violations of the Laws of the Game. Considering the amount of
discussions captains have with referees in today’s matches, it is
obvious how important the role of the referee is during the game.
 
3. NON-COMMERCIAL DISPUTES: DISPUTES BETWEEN
MEMBERS OF THE FIFA
 
The second area where disputes can arise in football is between
the (direct or indirect) members of FIFA, i.e. the confederations,
member associations, leagues, clubs, players and player’s agents.
As stakeholders in the game, they are directly or indirectly
affiliated to FIFA and fall under its statutes. The FIFA Statutes contain
an arbitration clause which requires that all disputes be finally decided
by the Court of Arbitration for Sport (CAS).1
