Two developing areas of law collided in a single case this term, as the Supreme Court considered both the finality of arbitral awards and the ability to form class actions in the context of an arbitration agreement. On June 10, 2013, the Court in Oxford Health Plans LLC v. Sutter reaffirmed the principle that arbitrator’s decisions are largely immune from court review.
