Many lawyers say mediation is good in concept but is not workable for the cases on their dockets. Mediation is frequently seen as effective and desirable for resolving community and family disputes but not practicable if the case turns on complex questions of contractual or statutory interpretation or requires adjudication of key factual issues. Such disputes seem to require yes or no rulings which are not achievable through mediation.
