MOTION TO STAY LITIGATION — ANTI-TRUST

Where a civil complaint contained eighteen counts, the first of which
was based on the Sherman and Clayton Acts, and where the remaining
17 counts sounded in tort and contract and contained arbitration clauses,
the court ruled that the interest of justice and the speedy resolution of
the matters would be far more expeditiously and economically obtained
if all the arbitrable issues were submitted to arbitration. This would
greatly reduce the fact Issues remaining in the anti-trust count. The
court made it clear that it was not ordering the anti-trust count to
arbitration. Black v. Econo-Car International, Inc., 404 F. Supp. 600
(D. Mass., 1976).
