A very long time ago, when I started out in the law, Swiss law had a
unitary concept of public policy, and it was called – public policy. By

now, all kinds of further words are added to the expression, and then it is

each time a mouthful, and it means a different thing each time. Or

perhaps not.

I. JUDICIAL REVIEW

A. Swiss Court’s Review Public Policy

Let me start with the judicial review of arbitral awards rendered by

international Arbitral Tribunals having their seat in Switzerland. This is

covered by Article 190(2) of Switzerland's Federal Private International

Law Statute (PIL Statue) which reads as follows:

2. Der Entscheid kann nur angefochten werden:

a. wenn der Einzelschiedsrichter vorschriftswidrig ernannt
oder das Schiedsgericht vorschriftswidrig zusammengesetzt
wurde;
b. wenn sich das Schiedsgericht zu Unrecht für zuständig
oder unzuständig erklärt hat;
c. wenn das Schiedsgericht über Streitpunkte entschieden
hat, die ihm nicht unterbreitet wurden oder wenn es
Rechtsbegehren unbeurteilt gelassen hat;
