Summary of Findings

Because preliminary research yielded little information on the finality of an arbitration award beyond incidental statements in cases or commentaries that the doctrines of res judicata and collateral estoppel do apply, the writer searched this apparently uncharted area for problems the doctrines might encounter because of procedural requirements set forth in Article 75 of the New York Civil Practice Law and Rules, and similar provisions in sister state statutes.
