An article on "Agreements to Arbitrate Claims under the Age Discrimination in Employment Act" that appeared in the December 1990 Harvard Law Review (vol. 104, no. 2, 568-587)- a portion of which is excerpted here- illustrates the benefits to employer and employee alike of expeditious settlement of employment disputes stemming from age questions. The advantages of arbitrating ADEA claims indude greater access to the legal system for older workers, greater flexibility in addressing employment problems and savings in time and cost.
