Le 19 décembre 1973, trois contrats rédigés en langue anglaise étaient signés entre la société de droit suédois A.B. Gotaverken et la société de droit libyen Libyan General Maritime Transport Organization à laquelle a succédé la société General National Maritime Transport Company (G.N.M.T.C.), relatifs à la construction par la première pour le compte de la seconde, de trois navires pétroliers jaugeant chacun 153.700 tonnes portant respectivement les numéros de coque 866, 892, 896, moyennant le prix unitaire de 40.750.000 dollars U.S.

 

Il était convenu que la livraison de chaque navire serait faite par le constructeur à l'acheteur en Suède (article 7) mais il était stipulé – sous l'article I, 2 (a) que les pétroliers seraient notamment construits en conformité avec "les lois et règlements maritimes de Libye".

On 19 December 1973, three contracts drafted in English were entered into by a company organised under Swedish law, A.B. Gotaverken, and a company organised under Libyan law, Libyan General Maritime Transport Organisation, which was then succeeded by the General National Maritime Transport Company (G.N.M.T.C.), for the construction, by the former for the latter, of three petrol tankers each with a capacity of 153,7000 tonnes, respectively bearing the hull numbers 866, 892, 896, for a price of US$ 40,750,000 each.

 

It was agreed that each ship would be delivered to the purchaser in Sweden by the builder (article 7), but, in Article I, 2 (a), it was stipulated that the tankers would notably be built in accordance with the “maritime laws and regulations of Libya.”
