I. INTRODUCTORY REMARKS
This paper reflects my presentation on the occasion of the 8th
Annual Meeting of the ICC Latin-American Group, which took
place in Cartagena, Colombia, on August 25, 2011. More
importantly, it also elaborates on my experience as a “Member of
the Drafting Committee of the ICC Task Force on Arbitrations
Involving States and State Entities”1 (hereinafter the Drafting
Committee),2 which was established by the ICC to address the
increasing importance in the ICC’s case load of arbitrations
involving States and State Entities.
It therefore transmits, henceforth, a very personal viewpoint
of the new 2012 ICC Arbitration Rules in light of my experience as
a member of the Drafting Committee. I have been careful not to
