I. INTRODUCTION
The Mexico City National Chamber of Commerce (“CANACO”)
was founded on August 27, 1874, as a private institution to serve,
protect and promote the interests of Mexican business people.
According to the applicable statutes of those years, the first
members of the Board of Directors were named in an audience,
and Mr. Esteban Benecke was named as the first president. With
the expedition of the first Chambers of Commerce and its
Confederations Law (“law”), on June 12, 1908, CANACO acquired
legal personality and adopted its actual denomination. Later on,
following the passage of a new law in 1936, it was considered
both as an institution of state collaboration and consultation. In
1941, the amendments to the law recognized it as a public and
autonomous institution, with its own juridical character.1 In 1997,
a significant modification to the law was implemented. It changed
the constitution of CANACO, by establishing that the affiliation of
traders to the Chamber would be voluntary.2 Most recently, in
2005, the law was modified, to address the integration of the
CANACO Board of Directors (“Board”).
II. CANACO COMMERCIAL MEDIATION AND ARBITRATION COMMISSION
Since its creation in 1874, the constitution of CANACO has
established the need to create a mechanism responsible for
resolving controversies between the trader-members of the
organization. It was not until around 1940, however, that
