The author brings his experience to bear on the question of how interest arbitration operates in practice. He finds that the parties tend to follow procedures with which they are most comfortable and those whose outcomes they are more likely to predict. Heavy reliance on med-arb in New Jersey is noted, as well as sharp changes in bargaining postures once interest arbitration is instituted. Final offer arbitration, he concludes, works well. In fact, it promotes negotiations between the parties.
