Sur le premier moyen, pris en sa sixième branche :

 

Vu les articles 1494, 1504, alinéa 1er, et 1502 3°, du nouveau Code de procédure civile ;

 

Attendu qu'il résulte de ces textes que si, dans l'arbitrage international, la mission conférée aux arbitres peut comporter des obligations particulières quant à la procédure à suivre, et notamment leur imposer de statuer par des sentences distinctes sur la compétence, sur la recevabilité et sur le fond, c'est à la condition que ces obligations résultent de clauses expresses et précises de l'acte de mission ;

On the sixth prong of the first argument:

 

In light of Articles 1494, 1504 para. 1, and 1502 para. 3 of the New Code of Civil Procedure;

 

Whereas according to these texts, although in international arbitration, the mission conferred upon the arbitrators can include specific procedural obligations, and can notably oblige them to provide separate awards on jurisdiction, admissibility and the merits, these obligations have to be set forth in explicit and specific clauses in the Terms of Reference;
