Attendu que la société Procofrance a sous-traité à la société Fougerolle des travaux dans le cadre du marché conclu avec la société Sonara pour la construction, au Cameroun, d’une raffinerie ; qu’à la suite d’un compromis prévoyant l’application de la loi française, au fond et à la procédure est intervenue, le 21 avril 1983, une sentence partielle qui a rejeté diverses demandes de Fougerolle et admis, dans leur principe, celles de Procofrance ; que les arbitres ont enjoint à Procofrance de produire la réclamation présentée par elle, le 3 octobre 1980, au maître de l’ouvrage et ayant abouti à une transaction, le 4 mars 1981 ; qu’au vu de ces pièces, la société Fougerolle a présenté une demande en révision de certains des chefs jugés par la sentence de 1983 ; que cette demande a été déclarée irrecevable par la sentence intérimaire du 13 décembre 1984 qui a statué sur d’autres chefs du litige initial et ordonné une expertise ;

Whereas Procofrance subcontracted work to Fougerolle in the context of an agreement entered into with Sonara to build a refinery in Cameroon; following a submission agreement providing for French law to be applied both to the merits and the procedure, a partial award was rendered on 21 April 1983 dismissing Fougerolle’s various claims and ruling principally in favor of Procofrance. The arbitrators requested that Procofrance produce the claim it submitted to the owner on 3 October 1980, which led to a settlement agreement on 4 March 1981; in light of this evidence, Fougerolle filed for a revision of certain claims ruled upon in the 1983 award. This request was deemed inadmissible by an interim award of 13 December 1984 which ruled on other aspects of the initial dispute and ordered an expert report;
