There is nothing inherent in copyright disputes that makes them unsuitable for arbitration, argues author Rupak Nag. Since traditional objections to arbitrating patent disputes have been removed, let’s do so for copyrights as well. The "dark cloud of uncertainty over copyright arbitration can be effectively cleared through congressional action," says Nag. As section 294 did for patent owners and practitioners, a voluntary arbitration section to the Copyright Act would give copyright owners and practitioners confidence that an arbitrator's decision will be respected by the courts.
