Most international arbitration conventions provide for challenges to an agreement to arbitrate based on the finding that the agreement is "null and void, inoperative or incapable of being performed." The following article examines the extent to which this provision can be applied in such challenges, giving particular attention to how the courts must confine their rulings according to the construction of the arbitration clause, public policy considerations, and statutory exceptions.
