The Egyptian Arbitration Law in Civil and Commercial matters no.

27 of 1994 (the “Law”) is based on the UNCITRAL Model Law on

International Commercial Arbitration (the “MAL”), as adopted in 1985

and before being amended in 2006.

 

Although the Law is inspired by the MAL, there are some

differences between both texts, among which the fact that, under the

Law, the arbitral tribunal does not have the authority to order interim

measures unless the parties have agreed to grant the arbitral tribunal such

authority.

 

The Law governs all procedural aspects of ad hoc arbitrations, but

does not specify the conditions nor enumerate the cases for the issuance

of interim measures, which are, therefore, governed by the general

principles enshrined in the Egyptian Civil and Commercial Procedures

Law no. 13 of 1968 (the “CCPL”).

 

With respect to institutional arbitrations, Egypt hosts the

headquarters of the Cairo Regional Centre for International Commercial

Arbitration (the “CRCICA”), an international arbitral organization

established in 1979 under the auspices of the Asian African Legal

Consultative Organization (AALCO). The present CRCICA Arbitration

Rules, in force as of March 2011 (the “ CRCICA Rules”), are based upon

the UNCITRAL Arbitration Rules as revised in 2010, with minor

modifications emanating mainly from the CRCICA’s role as an arbitral

institution and an appointing authority.
