As a result of the Civil Service Reform Act of 1978, federal employees may recover attorney's fees under certain conditions for grievances, appeals, and complaints in a variety of administrative proceedings, including grievance arbitration.

The author addresses the arbitrator's authority, pursuant to the Civil Service Reform Act, to award attorney's fees to grievants in federal sector arbitration proceedings. The article discusses the three criteria for attorney's fees awards under the act and outlines the administrative and judicial precedent that relates to each of those criteria. The author is general counsel to the GAO Personnel Appeals Board, one of the new personnel adjudicatory bodies created after passage of the Civil Service Reform Act.
