Schedule 11 of the Employment Protection Act, which seeks to extend the coverage of negotiated terms and conditions of employment, is one of the most controversial pieces of industrial relations legislation in Britain. This article analyzes arbitration decisions awarded under this schedule by examining the reported characteristics of a large sample. The extent of union success is considered and the factors associated with the likelihood of a decision being rendered in favor of a union claim are noted.
