On October 14, 1974, E. J. (Jake) Garn, Mayor of Salt Lake City, filed a charge with the Fair Campaign Practices Committee in Washington, D.C, against Wayne Owens, charging a violation of the fourth article of the "Code of Fair Campaign Practices."

Garn, Republican candidate for United States Senator from Utah wrote, " I request arbitration under your code and will abide by the findings of your arbitration." Owens, then an incumbent United States Congressman and Democratic candidate for the Senate, responded on October 21, saying in part, " I request that the Garn Complaint be dismissed and that my Complaint be submitted to arbitration as soon as possible." Owens also sent copies of his letter and Complaint to Common Cause and the League of Women Voters.
