TYPES OF COSTS ORDERS

• “Costs in the Reference:” used at an interim stage where the intention is that the party in whose favour the Arbitral Tribunal ultimately makes a substantive order for costs is entitled to the costs of that part of the reference to which the order relates, but also used in the sense of ‘Costs Reserved’ (see below).

• “Costs in any event:” used at an interim stage where the intention is that the party in whose favour the Arbitral Tribunal makes such an order is entitled to the costs of that part of the reference to which the order relates, irrespective of whatever other order(s) is (are) made in the Reference.

• “Costs Reserved:” used when the Arbitral Tribunal wishes to defer to a later date the decision; it is generally understood that if no further order is made the costs are treated as Costs in the Reference (see above).
