It can no longer be doubted that arbitration and ADR are making substantial inroads into the legal mainstream. The past year alone has produced an impressive string of high-profile developments: The Clinton administration incorporated ADR into two major policy initiatives-the National Performance Review and the health care reform plan; the ABA inaugurated its Section of Dispute Resolution, with much fanfare and impressive membership numbers; the House of Representatives passed a measure that would require federal courts to establish mandatory arbitration programs; private initiatives boosted the use and visibility of ADR at all levels of business and law.
