I. Introduction

Effective October 1, 2009, the American Arbitration Association (“AAA”) amended its Construction Industry Arbitration Rules and Mediation Procedures (“CIAR”), including Rules L-1 through L-6 that apply to large, complex cases (“LCCs”).1 This chapter follows up a 1998 article that discussed Preliminary Hearing process under 1996 CIAR L-4, then just amended,2 and comments on revised rule L-4 and new operative rules L-5 and L-6.3 Rule L-4 is a management rule for preliminary hearings. Rule L-5 is a management rule for formal hearings. And Rule L-6 is a rule calling for “reasoned awards” unless parties agree otherwise.
